These Terms and Conditions govern use of AmericanLibertyMetals.com and describe general conditions applicable to products and services offered by American Liberty Metals LLC (“ALM,” “we,” “us,” or “our”).

Please review these Terms carefully. If you do not agree to these Terms, please discontinue use of the website. Where affirmative acceptance is required, ALM will request that acceptance separately.

1. Scope and Customer Agreements

These Terms address website use, general purchasing information, and communications with ALM. Purchases may also be governed by a separate Customer Account Agreement, an accepted order confirmation, and other transaction disclosures provided before you commit to a purchase.

If these Terms conflict with a separately accepted Customer Account Agreement, that agreement governs the transaction to the extent permitted by law. Nothing in these Terms overrides rights or protections that cannot legally be waived.

Submitting a website inquiry or requesting a guide does not, by itself, place an order, lock a price, or obligate you to purchase.

2. Eligibility and Accurate Information

You must be at least 18 years old and legally able to enter into a binding agreement to purchase products or enroll in ALM’s marketing communications.

You agree to provide accurate contact, payment, and delivery information. If acting on behalf of another person or entity, you must have appropriate authority.

If you create an account, you are responsible for safeguarding your login credentials and promptly notifying ALM of suspected unauthorized access.

3. ALM’s Role and Educational Information

ALM sells physical precious metals, including bullion and coins. ALM has a financial interest in the products it sells and earns compensation through its product pricing.

Website articles, guides, market commentary, and general communications are provided for educational and informational purposes. They are not personalized investment, legal, accounting, or tax advice. Contacting ALM or purchasing a product does not, by itself, establish an investment-advisory or fiduciary relationship.

Consult your own qualified financial, legal, and tax professionals when evaluating whether a purchase, rollover, or account arrangement is appropriate for your circumstances.

4. Precious Metals Risks

Precious metals and collectible coins can increase or decrease in value. You may lose some or all of the amount invested. No statement on this website guarantees profits, preservation of purchasing power, protection against inflation, or a particular future value.

Physical precious metals do not pay interest or dividends. Returns depend on market conditions and the costs of acquiring, holding, and selling the products.

Purchase premiums, dealer compensation, resale discounts, shipping, storage, insurance, custodial charges, and applicable taxes may affect your results. Metal prices may need to rise substantially before you recover these costs.

Collectible or numismatic premiums can fluctuate independently of metal prices and may not be recovered upon resale. Past performance, historical examples, and projections do not guarantee future results. Diversification does not eliminate the risk of loss.

5. Pricing, Premiums, and Dealer Compensation

Spot prices, charts, tickers, and other market figures displayed on the website are informational reference points. They are not necessarily prices at which ALM will buy or sell a particular product.

Product prices may reflect metal content, availability, fabrication and distribution costs, condition, collectible characteristics, market demand, and ALM’s compensation.

A premium over spot, ALM’s gross margin, and the difference between a dealer’s selling and repurchase prices are different measurements and should not be treated as interchangeable.

Where ALM’s Customer Account Agreement uses the term “Spread,” its meaning and any applicable calculation are governed by that agreement. The transaction’s pricing and applicable charges will be disclosed before you commit to purchase.

Where required by applicable law, advertised or listed prices include mandatory fees and charges, except permitted exclusions such as qualifying shipping charges and government-imposed taxes.

“Call for Live Pricing” means that you should contact ALM for a current quote. Quote validity, price-lock conditions, and payment requirements will be communicated as part of the order process.

6. Orders, Availability, and Product Descriptions

Product listings are subject to availability. Before accepting an order, ALM will confirm the products, quantities, price, and other material transaction terms.

Images may illustrate a product type rather than the exact item supplied. The applicable order description governs the agreed year or assorted-year selection, size, metal content, condition, finish, packaging, and other material specifications. ALM will not substitute a materially different product without your agreement.

We seek to maintain accurate descriptions and pricing. If an error is discovered, we will communicate it and address any affected order consistently with the accepted transaction terms and applicable law. These Terms do not authorize ALM to unilaterally increase an accepted order’s price.

7. Payment and Verification

Accepted payment methods, payment deadlines, and any price-lock conditions will be disclosed during the order process.

ALM may request information reasonably necessary to verify identity, payment authorization, or compliance with applicable legal requirements. Do not submit payment-card information, Social Security numbers, passwords, or other sensitive financial information through general website inquiry forms or text messages.

Payment clearing requirements and their effect on shipment timing will be disclosed before purchase. Any such requirements remain subject to applicable shipment and refund laws.

8. Shipping and Delivery

The applicable order documents and Customer Account Agreement explain shipment timing, delivery arrangements, and any shipping charges. ALM must have a reasonable basis for its stated shipment timeframe.

If ALM cannot ship within the applicable timeframe, ALM will provide notices, seek consent to a delay, or issue refunds as required by law. A statement that ALM will use reasonable efforts does not eliminate applicable cancellation or refund rights.

Non-IRA orders will be delivered to the address confirmed for the transaction. IRA purchases will be delivered according to the qualified custodian’s instructions and applicable account requirements.

Please inspect deliveries promptly and contact ALM if an order appears damaged, incomplete, incorrect, or missing. Preserve packaging and relevant documentation to assist investigation. Any contractual claim procedures remain subject to nonwaivable legal rights.

Insurance coverage, signature requirements, and responsibility for loss during shipping are governed by the applicable transaction terms and law. General references to secure delivery do not establish unlimited insurance coverage.

9. Cancellations, Returns, and Refunds

Cancellation, return, and refund conditions will be disclosed before you place a binding order and will be governed by the applicable Customer Account Agreement, accepted order terms, and law.

Any market-loss charge, cancellation fee, or other contractual charge must have a lawful basis and be disclosed and agreed to where required. These website Terms do not independently impose a cancellation fee or declare all purchases nonrefundable.

Contact ALM promptly regarding cancellation requests or product concerns. Nothing in this section limits rights relating to defective, misdescribed, undelivered, or otherwise nonconforming products, or statutory shipment-delay refunds.

10. Resale and Buyback Inquiries

Unless ALM expressly agrees otherwise in writing, purchasing a product does not create a guaranteed repurchase obligation or guarantee a future resale price.

Any repurchase offer may depend on market conditions, product type, authenticity, condition, quantity, and ALM’s purchasing requirements at that time. A resale or repurchase price may be less than the original purchase price, even if the underlying metal’s spot price has increased.

11. Precious Metals IRAs

Only certain precious metals and coins qualify for ownership within an IRA. Eligibility depends on applicable law, the specific product, and the custodian’s acceptance requirements.

ALM’s product descriptions do not constitute an IRS endorsement or guarantee of tax treatment. Customers should confirm eligibility with their qualified custodian and tax adviser before purchasing for an IRA.

IRA metals must be held under custody arrangements that satisfy applicable law. Personal possession or improper handling can create taxable distributions or other adverse consequences.

Rollovers, transfers, contributions, conversions, and distributions are subject to account-specific rules and restrictions. Custodians and storage providers may charge separate fees. Their responsibilities and charges are governed by their own agreements.

12. Calls, Emails, and Text Messages

ALM may respond to inquiries through the contact methods you provide, consistent with your request, applicable consent, and law. Agreeing to these Terms or providing a telephone number does not, by itself, enroll you in recurring marketing text messages.

When you separately opt in, ALM may send SMS/MMS messages within the scope of your consent. Messages may include inquiry responses, requested information, appointment coordination, customer support, transaction or delivery updates, and marketing about ALM products and services.

Marketing text consent is voluntary and is not a condition of purchasing or receiving a requested guide. Message frequency varies. Message and data rates may apply.

Reply STOP to opt out of text messages or HELP for assistance. You may also contact info@americanlibertymetals.com or 888-673-8507. ALM honors other clear requests to stop text messages. You may receive one nonmarketing confirmation of your opt-out.

Message delivery depends on carrier and network availability. Carriers are not liable for delayed or undelivered messages. Notify ALM if you change or relinquish an enrolled number.

ALM does not sell, rent, or share mobile opt-in information or text-message consent with third parties or affiliates for their own marketing or promotional purposes. Providers assisting with delivery, support, or consent management may process information on ALM’s behalf as described in our Privacy Policy.

13. Website Content and Third-Party Services

Market information may be delayed, incomplete, or affected by third-party interruptions. Estimates and projections are not official real-time measurements unless expressly identified as such.

Links to third-party websites are provided for convenience or reference. A link does not necessarily imply endorsement, affiliation, or responsibility for the third party’s content or services.

Unless otherwise stated, ALM or its licensors own the website’s original content and branding. You may use that material for personal, noncommercial informational purposes. Other uses require permission or an applicable legal exception. Third-party names, marks, and materials remain the property of their respective owners.

14. Acceptable Use

You may not use the website to commit fraud, impersonate another person, submit information without authorization, distribute malicious software, interfere with website operation, or access systems or information without permission.

ALM may restrict access reasonably necessary to protect users, investigate misuse, or maintain security, subject to applicable law.

15. Website Availability and Limits

To the extent permitted by law, website access and general informational materials are provided on an “as available” basis without a guarantee of uninterrupted or error-free operation.

ALM is not responsible for indirect or consequential losses arising solely from website outages or reliance on general website information, to the extent such a limitation is enforceable.

These limitations do not disclaim agreed product specifications, express transaction promises, nonwaivable warranties, or liability that applicable law does not permit ALM to exclude, including applicable liability for fraud, willful misconduct, or gross negligence.

16. Changes and Applicable Rights

ALM may update these Terms and will identify the effective date of the revised version. Material changes will be communicated as required by law, and additional acceptance will be obtained where required.

Updates do not retroactively alter accepted orders or separately executed agreements without a valid legal basis or the required agreement.

Applicable federal and state law governs these Terms. Nothing here creates mandatory arbitration, a class-action waiver, or an exclusive court venue. Any separately accepted dispute-resolution agreement must be evaluated under its own terms and applicable law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.
